Severance of Joint Tenancy is an important part of estate planning arrangements. Clients commonly wish to ensure that "their share" of the family home is received by their intended beneficiaries. If the home is owned as Joint Tenants (the great majority) then this is not possible because the survivor automatically becomes the sole owner irrespective of intentions expressed in a Will.
Tenants in Common is a more flexible way of owning property with a partner. Not only can each will their share independently but there can also be advantages for inheritance tax planning and guarding against the provisions of the Community Care Act for long term residential expenses.

The Mutual Notice of Severance of Joint Tenancy must be signed by both parties.
