Lasting Power of Attorney

Lasting Power of Attorney (LPA) was introduced in October 2007 and supercedes the previous Enduring Power of Attorney (EPA).

Forms in this module are pdf documents in the required format with an overlay of fill-in fields allowing on-screen completion of client instructions.

There are several new facilities and requirements for LPAs:

There are two versions LPA for Personal Welfare and LPA for Property and Affairs (financial matters). Donors can set up an LPA for either one or both. Different attorneys can be appointed for each type.

Unlike the old EPA, LPAs allow for the appointment of replacement trustees.

LPAs have to be registered before they can be used. They cannot be used, even on a temporary basis such as the donor working abroad for a period, if they have not been registered with the Office of the Public Guardian (OPG).

Each completed LPA form needs to be 'certified' by the person preparing it. If you complete LPA forms forms for a donor, you have to make a statement about your qualifications and/or experience to be the certificate provider.
